frequently asked questions
WHAT DO WE HANDLE?
WHAT IS PROBATE?
Probate is a legal process that occurs after a person's death, in which their assets are distributed according to their will or state law. It can be a lengthy and expensive process, so it's often advisable to take steps to avoid probate through estate planning strategies.
Comprehensive estate plans, special needs truss, revocable living trusts, powers of attorney, advance health care directives, last wills and testaments, special needs trusts, pet trusts, etc.
WHAT IS ESTATE PLANNING?
WHAT IS A SPECIAL NEEDS TRUST?
A special needs trust is a legal arrangement that provides for the financial care of a person with a disability while preserving their eligibility for government benefits. It is typically set up by a parent or guardian and can be funded with assets or life insurance.
Estate planning is the process of arranging for the management and distribution of a person's assets after their death, to ensure that their wishes are carried out and to minimize taxes and other costs. It may include the creation of wills, trusts, powers of attorney, and other legal documents.
WHAT IS A HEALTH CARE PROXY?
HOW LONG DOES IT TAKE?
Our estate planning process typically takes between 4-6 weeks to complete, during which we work closely with clients to understand their unique needs and create a personalized plan that meets their goals for asset management and distribution.
A healthcare proxy is a legal document that designates a trusted individual to make medical decisions on behalf of a person if they become unable to make decisions for themselves. This person is typically chosen by the individual and should be someone they trust to make important healthcare choices for them.
IS A SIMPLE WILL ENOUGH?
bENEFITS OF A TRUST VS. WILL?
A simple will may not be enough to adequately address all of a person's estate planning needs, as it typically only covers the distribution of assets and does not address issues such as incapacity, taxes, or the management of assets for minor beneficiaries.
Compared to a will, a trust offers several benefits such as the ability to avoid probate, provide for the management of assets during incapacity, protect privacy, and create ongoing trusts for beneficiaries, including those with special needs. Trusts also offer more flexibility in how assets are distributed.
HOW DO I NOMINATE GUARDIANS FOR MY KIDS?
WHAT IS A POWER OF ATTORNEY?
A power of attorney is a written authorization that grants someone the legal authority to act on behalf of another person in matters related to finances, healthcare, or other important decisions. It is important to exercise caution when creating and using a power of attorney, as it grants someone significant legal authority over one's affairs.
To nominate guardians for minor children, individuals can create a legal document specifying who they would like to take care of their children if they are unable to do so. It's important to choose someone who is willing and capable of caring for the children, and to regularly review and update the document as circumstances change.
